Terms of Service

Center Console Agent is a free, location-aware search engine for boat parts. It helps boaters and marine professionals find parts in stock at nearby marine shops, with price and distance. Shops list for free and sync their inventory from their point-of-sale systems.

The Service is verify-only. We do not sell parts, take payment, process checkout, or fulfill orders. Any purchase, pickup, price, warranty, or return is solely between you and the shop. We are not a party to that transaction.

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service. The Service is not directed to children.

You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your sign-in credentials secure and notify us promptly of any unauthorized use. We sign you in with magic links; do not share them.

Each account is tied to a user identifier we assign. You may not impersonate another person or business, or create an account on behalf of an entity you are not authorized to represent.

Boaters and customers may search, save pickup lists, add boats and engines, and contact shops.

Shops and businesses may create listings, connect a point-of-sale system, and publish inventory, pricing, brand, and location information. You represent that you are authorized to list the business and to share the data you connect.

Marine professionals may apply to appear in our directory. Listing is subject to review and approval, and we may decline or remove a listing at our discretion.

Brands and manufacturers may have information surfaced or curated on the Service. Brand names and SKUs are identifiers and are presented as such.

When you connect a point-of-sale or other integration, you authorize us to access, retrieve, store, normalize, and display the data made available through it, including products, SKUs, quantities, prices, categories, and locations, and to keep it synced. You are responsible for the accuracy of that data and for your use of any third-party integration, subject to that third party's terms.

Inventory counts, prices, and availability are provided by shops and their systems and may be out of date or incorrect. We do not guarantee that any item is in stock, priced as shown, or available for pickup.

We may normalize, re-categorize, deduplicate, enrich, translate non-brand fields, and otherwise process listing and inventory data to operate and improve the Service.

'Your Content' means anything you submit, upload, sync, or make available through the Service, including business and inventory data, listings, profiles, boats and engines, build sheets, reviews, messages, and other materials.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, modify, adapt, translate, create derivative works from, publish, publicly display, distribute, and otherwise use Your Content to operate, provide, secure, improve, develop, promote, and commercialize the Service and our business.

This license continues for Your Content that you have shared with others or that is incorporated into aggregated, derived, or de-identified data, even after you close your account, as described in Section 6 and our Privacy Policy.

You represent that you have all rights necessary to grant this license and that Your Content does not violate any law or third-party right.

We collect, generate, and maintain data through the operation of the Service, including listings, inventory, pricing, search activity, demand signals, location and distance data, usage, and trends. As between you and us, and except for your underlying ownership of Your Content, we own all rights in the Service and in the data, databases, compilations, analytics, models, insights, reports, and other materials we create from operating the Service.

We may aggregate and de-identify data, so that it does not identify you or any individual, and may use, reproduce, analyze, combine with other sources, license, sell, publish, and otherwise commercialize that aggregated and de-identified data for any purpose, including market research, benchmarking, demand and pricing trends, industry reports, and product development. This right survives termination and is perpetual and irrevocable.

We may use Your Content and other data to develop and improve features, tune ranking and models, generate insights and trend data, and create new products and services.

Nothing in these Terms requires us to retain, return, or delete aggregated or de-identified data, or data we are required to keep by law.

You agree not to: scrape, crawl, harvest, or bulk-extract data except as we expressly allow; resell or redistribute the Service or its data; misrepresent inventory, identity, or affiliation; upload unlawful, infringing, or harmful content; interfere with or probe the Service's security; use the Service to send spam or unlawful communications; or use the Service to build or train a competing product or dataset.

We may monitor, moderate, suspend, or remove content and accounts that we believe violate these Terms or harm the Service, users, or third parties.

The Service, including its software, design, text, graphics, logos, and the Center Console Agent name and marks, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. Brand names and SKUs belong to their respective owners and are used for identification only.

The Service relies on and links to third-party services, such as mapping, point-of-sale, and authentication providers. We are not responsible for third-party services or content, and your use of them is governed by their terms.

The Service is provided 'as is' and 'as available', without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, completeness, availability, or reliability of listings, inventory, pricing, distances, directions, or professional listings. You use the Service, and rely on any information from it, at your own risk.

To the maximum extent permitted by law, we and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (or its equivalent). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive termination, including Sections 5, 6, 8, 10, 11, 12, and 15, survive.

We may modify or discontinue the Service or any feature at any time. We may update these Terms; when we do, we will revise the 'last updated' date and, for material changes, provide reasonable notice. Your continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules. The courts located in [STATE] will have jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. Where permitted, disputes will be resolved on an individual basis, and you and we waive any right to a class or representative proceeding.
